Terms Of Use
Confirmation Of Booking
As required by Department of Employment regulations, Bubblegum’s booking form containing the terms of the booking must be signed and returned by the client prior to job taking place. Failure to return the signed confirmation form will be deemed to be an acceptance by the client of these terms and conditions applying to the booking between the Agency and the client.
Any Artiste introduced to a client through Bubblegum must be booked via the agency. This applies to all future assignments.
Usage
In general, booking fees cover the right to use one image for one year from the date of the booking, in the UK only, for the initial Permitted Use.
The initial media, territory and period of usage of the images must be negotiated prior to the booking and confirmed in writing and signed by Client at the time of booking.
Additional fees are payable for the right to use the photographs for all known or anticipated purposes other than the initial media permitted use.
Use Of Images
It is the client's responsibility to notify the agent and negotiate additional fees and extensions of existing agreements for any usage, which may be required or anticipated at the time of booking.
Fees must be paid in full before and additional usage is permitted for any purpose whatsoever.
Daily & Hourly Rates
Excluding equity contracts, models' time will be charged at the hourly rate unless a half day or full day booking has been pre-arranged in writing.
All fees are based on the following:
Full day = 8 hours
Half day = 4 hours
Minimum booking = 2 hours
Overtime
Overtime is charged at the agreed hourly rate and taken to the next hour up. Overtime rates apply outside 0900-1800 hours & on all bookings longer than 8 hours.
The rate between 1800hrs & midnight is 150% of the normal daily rate. Overtime between midnight & 0900hrs is to be negotiated.
All work on Sunday’s & Bank Holidays is 200% of the daily rate.
The rate for night work will be negotiated for any work between the 24:00 and 09:00 hours.
Travel
Travel is charged at 50% of the hourly rate and applies to travel outside a 5-mile radius of Hyde Park Corner. Travel expenses are payable to the model on the day of the booking.
Location Bookings
Transport must be provided for the model to and from the location unless otherwise agreed. The Agency shall be entitled to re-charge the cost of the transport to the model.
Licences
It is law that all children under compulsory school age have a Child Performance Licence in place for every shoot they take part in. It is the clients' responsibility to apply for these. We can process the application for you if you'd prefer. The charge for this service is £25 per licence.
Meals
Clients are responsible for models' meals and beverages on bookings.
Mixed Agency Bookings
In the event that models from another agency are working on the same assignment and providing the same services as models from Bubblegum at a higher rate then Bubblegum reserves the right to charge at the same rate.
Provisional Bookings
Provisional bookings will be automatically cancelled if they are not confirmed within 24 hours of the proposed booking or if a definite booking is offered and the provisional cannot be confirmed.
Invoicing & Payment
For all bookings, excepting equity contract TV commercials, the agency charges a supplement of 20% on all hourly, daily and overtime fees and all fees for the right to use and all fees negotiated for any other service to be supplied by the model. The agency and model fees will be invoiced by the Bubblegum unless it is otherwise agreed at the time of booking. The model disbursement is included at 66.7% and the agent's fee at 33.3% of the invoice total. All fees and any agreed expenses are exclusive of VAT will be payable in full by the client.
Payment on all invoices is required within 30 days of the date of invoice. In all cases the person booking the model will be invoiced and solely responsible for payment unless otherwise agreed at the time of booking. The Agency reserves the right to invoice the 'ultimate client'. Failure of the client to pay in full on the due date of any amount outstanding before or after any judgment shall bear interest at 5% over the base rate until such payment is made in full. Any interest will be compounded and accrued on a daily basis.
All fees for usage are for the right to use the model's image. Once agreed these fees are payable whether or not the right is exercised unless the agency agrees in writing. No usage for the model's image is permitted until payment is made in full.
Exclusive Fees
Models supplied by the Bubblegum are on a non-exclusive basis and are free to provide a similar service to any competing brand of the client. An additional exclusivity fee will need to be agreed when the models image is required on an exclusive basis. The Client is responsible to check whether the model has undertaken any conflicting work.
Cancellation Fees
If a booking is cancelled within three working days of the starting time the full fee will be charged, unless the same model is rebooked by the same client within 24 hours, in which case 50% of the fee is charged.
If a booking is cancelled outside the three-day period but within five working days of the starting time, 50% of the fee will be charged.
If a booking is cancelled outside the five-day period, 25% of the fee will be charged.
For trips and long bookings; if the booking is cancelled within a period equal to the length of the booking then the full fee is charged.
If a booking is cancelled because of illness or some other reason beyond the models or Agent's control, neither the Agency nor the model shall be liable for cancellation charges.
Weather Permitting Bookings
This must be made clear at the time of booking. At the first cancellation, 50% of the fee is charged unless the client fails to cancel in time to prevent the model's attendance, when the full fee will become payable. At the second cancellation the full fee is charged.
Insurance
The client is responsible for the models health and safety when the model is travelling, or providing services in connection with the booking to the same extent as if the model were an employee of the client. The client will maintain adequate insurance cover to underwrite its obligations to the model.
The agent is not responsible if the model fails to attend the booking. The client is advised to insure against any loss that might result if the model does not keep a booking because of ill health or some other reason.
Additional Usage

Additional fees are payable for the right to use the photographs or reproductions of, or adaptations of, either complete or in part, alone or in conjunction with any wording or drawings for all known or anticipated purposes other than the initial media permitted use such as packaging, posters, leaflets and display cards etc. The additional fees cover the right to use an image for one year from the date of booking, in the UK only, for the purpose or purposes agreed.
The proposed initial media, territory and period of usage of the images must be negotiated prior to the booking and will be shown on the Booking Confirmation sent by the Agency to the Client at the time of booking.
It is the client's responsibility to notify the agent and negotiate additional fees including extensions of existing agreements for any usage, which may be required or anticipated subsequent to the time of the booking. It is not permitted to use the photographs for any purpose whatsoever until all fees have been paid in full.
Copyright
The photographer is not entitled to use any of the images he/she takes for any usage (apart from his/her personal portfolio) beyond that agreed. The photographer to this extent agrees to restrict use of his/her copyright and, if the model agency client is not a photographer, the client is to draw these terms and conditions to the attention of the photographer and obtain his/her agreement to them before the shoot commences.
The model release form must be signed at the end of every booking by the model and the client.
Complaints
Any cause for complaint should be reported to the agency when it arises. Complaints cannot be considered in retrospect.
Whilst every effort is made to provide a satisfactory and efficient service to clients the Agency cannot be held responsible for a model's conduct nor for any costs incurred by a model's lateness or non-appearance at an assignment. Our fees are charged at the end of every assignment there are not normally any circumstances where refunds apply.
General
All fees are to be negotiated only with Bubblegum and we reserve the right to negotiate within the structure of these terms and conditions.
These terms and conditions are without prejudice to any claim against the client.
As a supplier of services, these terms and conditions take precedence over terms and conditions that may be received from the client even when those terms and conditions have a similar clause to this.
These terms and conditions for booking and all other matters connected with the bookings are governed by English Law and any dispute will be settled in accordance with that law by a court in England.
